Welcome to Tyson Transport & Rentals LLC (“we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website, online booking system, and informational referral features. By accessing our website, completing a booking, or submitting information through any form on our site, you (“you,” “renter,” or “user”) agree to these Terms. Please read them carefully before using our services.

1. General Use of Website

By using this website, you agree:

To provide accurate, complete, and up-to-date information when submitting inquiries, insurance quote requests, or bookings.
That you are at least 21 years of age and possess a valid driver’s license if renting a trailer.
Not to use this site for any unlawful or fraudulent purpose.

We reserve the right to refuse service or cancel a booking at our discretion for violations of these Terms, our Rental Agreement, or for fraudulent form submissions.

2. Booking & Payment Policy

When making a booking through our website:

The total rental charge is required to secure your reservation.
The Security Deposit is due at pickup.
Payments are processed through our secure payment processor.
All bookings are subject to our approval. Submission of a booking request does not guarantee availability until confirmed in writing by Tyson Transport & Rentals LLC.

3. Legal Acceptance & Consent

At checkout, or when submitting an inquiry form, you will be required to check a box or click a button indicating your consent to the Tyson Transport & Rentals LLC Terms & Conditions and Privacy Policy. By doing so, you acknowledge that:

You have read, understood, and agree to be legally bound by these Terms and the applicable Rental Agreement in full.
Your electronic acceptance serves as your legally binding signature under applicable law (E-SIGN Act).
If you do not agree to these Terms, you may not complete a booking, submit a request form, or use our rental services.

4. Cancellations & No-Shows

The total Rental Charge is collected at the time of booking. Cancellations made within 72 hours of the scheduled pickup date and time are non-refundable, and the full Rental Charge will be retained by Tyson Transport & Rentals LLC. Any Security Deposit collected at pickup is separate from the Rental Charge and will be handled according to the applicable Security Deposit provisions of this Agreement.

Cancellations made more than 72 hours before the scheduled pickup date and time may be eligible for a refund, subject to the terms of this Agreement. Any approved refund will be issued to the original payment method and will be reduced by: Applicable payment processing fees incurred when the original payment was processed; and a 2% cancellation and administrative fee calculated on the refundable Rental Charge. Payment processing fees are non-refundable because they are retained by the payment processor.

No-Shows: If the customer does not arrive within the scheduled pickup window and fails to contact us, the reservation will be marked as a no-show, and the Rental Charge(s) will not be refunded. The trailer may then be released to other customers.

5. Security Deposit & Additional Charges

A Security Deposit is collected at pickup to cover potential damages, losses, tolls, or late fees. If damages, violations, or other unpaid charges occur, Tyson Transport & Rentals LLC reserves the right to:

Deduct the costs from the Security Deposit, and/or
Charge the payment card on file for any balance due beyond the deposit.

You remain responsible for all fees and violations incurred during your rental period, regardless of when we receive notice.

6. Damage, Loss, & Liability

You agree to assume full responsibility for the trailer and all included equipment during your rental period. You are financially liable for:

Damage, theft, vandalism, loss of use, or diminished value of the trailer;
Damage caused by improper towing, negligence, or unauthorized drivers;
All tolls, tickets, impound fees, or violations incurred during rental.

We reserve the right to recover all associated costs and administrative fees as outlined in the Rental Agreement.

7. Abandonment & Recovery

Failure to return the trailer within the designated period, or failure to maintain contact after the rental has ended, may result in the trailer being declared abandoned. In such cases, Tyson Transport & Rentals LLC may:

Repossess the trailer at your expense,
Retain or apply your Security Deposit, and
Pursue additional recovery, towing, or legal fees.

8. Website Content & Intellectual Property

All text, images, logos, and media on this website are owned or licensed by Tyson Transport & Rentals LLC. You may not copy, reproduce, or use any materials for commercial purposes without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

Tyson Transport & Rentals LLC is not responsible for indirect, incidental, or consequential damages arising from the use of this website, our rental services, or third-party business introductions.
We make no guarantees that our website will be error-free, secure, or uninterrupted.

10. Privacy & Data Security

We respect your privacy. Personal information collected through our website is used for booking, communications, and requested third-party partner matches, and is handled in strict accordance with our Privacy Policy.

11. Insurance Referral Services & Third-Party Communications

Tyson Transport & Rentals LLC provides an optional informational referral feature connecting website users with independent, licensed insurance professionals.

Independent Intermediary: We are not an insurance broker, insurance agency, or insurance carrier. We do not sell, underwrite, or bind insurance policies, nor do we guarantee the availability, approval, or pricing of any personal or commercial insurance rates.
Liability Disclaimer: All policy discussions, negotiations, and transactions occur strictly and directly between you and the independent third-party insurance agent. We are not liable for any coverage gaps, underwriting disputes, or interactions resulting from these introductions.
Express Communications Consent (TCPA Compliance): By voluntarily submitting your information into our insurance check form and clicking the submission button, you provide your express written consent for Tyson Transport & Rentals LLC to share your form data with our contracted, independent local partner insurance agents. You explicitly authorize these licensed professionals to contact you directly via phone calls, automated text messages, or emails using the contact information you provided to deliver your requested premium comparisons. This express consent applies even if your telephone number is currently listed on any local, corporate, state, or national Do Not Call registries.

12. Governing Law

These Terms and all related transactions are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any disputes or legal claims arising under these Terms shall be resolved exclusively in the appropriate courts of Clayton County, Georgia.

13. Updates to These Terms

We may modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to this page. Your continued use of the website or form submission after updates constitutes acceptance of the new Terms.
